Frequently Asked Questions

  1. You will need the document(s) that needs to be notarized.
  2. The document(s) need to be filled out completely.
  3. The signers need to be competent, willing, and aware of what they are signing.
  4. The signers need to have some form of non-expired government issued ID (provided the ID is current or was issued within 5 years).
  5. Know which notary certificate is needed. Notaries cannot give you advice on which certificate to use. This is usually already attached to your form(s).

Identity is established when the notary public is presented with satisfactory evidence of the signer’s identity. Click here to see the full list of acceptable identification.

Sometimes the notarial wording is not found on the document you need notarized. When this happens, the signer should ask the receiving agency what type of notarization is needed. The signer may also seek advice from an attorney or choose the act yourself.  For signatures, your choices include an Acknowledgement, which proves you signed the document, or a Jurat where the signer swears/affirms that what they are about to sign is true and correct.

A Remote Online Notary (RON) is a commissioned notary public who performs notarizations entirely online using secure digital tools, eliminating the need for in-person meetings.

How It Works (in RON-Authorized States):

  1. Identity Verification

    • The signer presents a government-issued ID (e.g., driver’s license, passport) via live video.

    • The notary may use knowledge-based authentication (KBA) or credential analysis to confirm identity.

  2. Digital Document Submission

    • The document is uploaded to a secure RON platform.

  3. Live Audio-Visual Session

    • The notary and signer meet via real-time video call (like Zoom but with compliance features).

    • The signer electronically signs the document in the notary’s presence.

  4. Digital Notarization

    • The notary applies their electronic seal/signature and attaches a digital certificate.

    • The finalized document is sent to all parties with an audit trail for legal proof.

Key Features of RON:

  • Geographic Flexibility: Signers and notaries can be in different locations (but must comply with state laws).

  • Enhanced Security: Encryption, tamper-proof seals, and session recordings prevent fraud.

  • Faster Turnaround: No travel required—ideal for urgent or international signers.

Limitations:

  • State Laws Vary: Only valid if the notary is commissioned in a RON-authorized state (e.g., Florida, Texas, Virginia, etc.).

    • Example: A Florida RON notary can notarize a document for a CA resident, so long as the document is not governed by California law.

  • Not All Documents Qualify: Some (e.g., wills, real estate deeds) may require in-person notarization depending on state rules.

California’s RON Status as of 2025:

  • CA has not yet permanently authorized RON (pending legislation).

  • For now, CA residents must use:

    • In-person notaries for CA documents.

    • RON notaries from other states for documents not governed by California law.

Yes! As a California resident, you can use Remote Online Notarization (RON) for your documents, but only if the notary is commissioned in a state that allows RON and follows that state’s notarial laws.

 

Here’s how it works:

 

✔ California does not yet permit its notaries to perform RON, so a CA-commissioned notary cannot notarize your document online.
✔ However, if a notary commissioned for RON in a RON-approved state (like Florida, Texas, or Virginia) notarizes your document online, it can be legally valid as long as:

 

  • The notary follows their state’s RON laws.

  • The document is not strictly governed by California law (e.g., CA real estate deeds, CA wills).

  • The receiving party (bank, court, employer, etc.) accepts an out-of-state RON notarization. Check before notarizing!

Example:

  • If you’re signing a California-based business contract, a Florida RON notary can notarize it for you remotely.

  • If you need a California-specific document (like a CA power of attorney), you’ll still need an in-person notarization with a CA notary.

It’s uncertain. A 2023 bill (CA SB 696) proposed RON but has stalled. For now:

  • Track updates via the CA Secretary of State.

  • For CA documents, use Legacy In Ink Services or in-person/mobile notaries.

  • For eligible documents, use RON notaries commissioned in RON-approved states.
